This Privacy Policy (“Policy”) explains how personal information about you is collected, used, disclosed, communicated, and stored (or collectively “processed”) by Mitsubishi Motor Sales of Canada, Inc. (“MMSCAN”, “we”, “us” and similar terms) (i) with respect to your use of the MMSCAN website (the “Site”); (ii) when you test drive, seek financing for or purchase a Mitsubishi vehicle; (iii) in the course of our marketing and other business development activities; and (iv) when you contact us by telephone.

This Policy does not apply to personal information processed by MMSCAN or any of its affiliates in connection with our connected vehicle services. We reserve the right to amend this Policy at any time. We will post updated information about our policies and practices relating to the processing of personal information on our Site, and where required by law we will notify individuals with whom we have a relationship of significant changes that affect them (and obtain any additional, required consents).

How We Collect Information and What Information We Collect
. We collect personal information directly from you and your devices, from dealerships you visit or interact with, from our financial partners, by recording inbound and outbound telephone calls, and through the use of tracking technologies, such as cookies and pixels on the Site and on social media pages. We collect personal information such as your name, title, marital status, date of birth, email address, mailing address, telephone number, company name, company department, location, vehicle selection, configuration selection, budget information, mileage, information regarding your eligibility for deals and rebates, content of any messages that you send to us, information provided in your credit application (if applicable), your feedback, information about your computer or device (such as operating system, IP address, browser type, language), access time to our Site, referring website, your usage and activity on our Site, and other personal information that you provide to us. If you speak with us by telephone, we may also collect recordings of your voice and any personal information that you share with us during our call.

How We Use Information
. We use personal information we collect to administer and process services and products requested by you, to calculate and present available and relevant offers and inventory to you, to notify you of the closest Mitsubishi dealer, to generate statistics, measure the Site activities and personalize your experience on our Site, to detect and prevent security threats, to understand customers’ automotive needs, to increase awareness of the MMSCAN brand, products and services, to develop, market and promote our brand, products and services, to communicate with you, to provide you with customer service, to enable our dealerships to provide a quote on your selected vehicle, book a test drive or contact you regarding your inquiry about our products and services, to improve our products and services, to retain recordings of our telephone calls, for quality control and employee training purposes, to aggregate and generate reports on advertising lead sources, to process and deliver contest entries and rewards, to comply with applicable law or lawful authority, to exercise or defend legal claims, and for such other purposes as are permitted or required by applicable law.

We may assign customers a unique internal identifier to help keep track of their future visits. We use this information to gather aggregate demographic information about customers, and we may use it to personalize the information customers see on the website and some of the electronic communications customers receive from us (if they have they provided their consent to receive such communications). We keep this information for our internal use, and this information is not shared with others.

MMSCAN does not knowingly collect information for individuals under the age of 14.

How We Share Information
. We may share personal information with third parties, including our affiliates, suppliers, service providers, contractors or agents (including providers of emergency services, roadside assistance services and connected car services) that perform services on our behalf, our dealerships, for legal compliance, or in connection with a business transfer.

Locations of Processing
. Personal information we collect or otherwise process may be transferred outside of Canada, including to the United States, the United Kingdom, Ireland and Japan. Such personal information may be accessible to courts, law enforcement and national authorities in such other countries. If you are located in Quebec, please note that your personal information may be communicated or stored outside of Quebec.

Your Rights / Contact Information

Depending on the jurisdiction where you are located, you may have the right to withdraw your consent to our continued processing of your personal information and/or to access, update and/or request correction of your personal information, subject to certain limitations permitted or required by applicable law. 1. CONSENT


The way in which MMSCAN obtains your consent to collecting, using, or disclosing your personal information varies depending upon its sensitivity and applicable privacy law. We may ask for your consent directly or our dealers may obtain your consent on our behalf. Your consent also may be implied or implicit through your conduct when it is reasonable and legally permissible for us to do so.

We will honour any specific consents you provide to us regarding the collection, use, or disclosure of your personal information. You may withdraw or change your consent at any time, subject to legal or contractual restrictions, by giving us reasonable notice. In appropriate cases, we will inform you of any implications of withdrawing your consent. Notwithstanding the foregoing, we reserve the right to retain, collect, use, and disclose your personal information and to contact you where we are legally required or permitted to do so.

We will not, as a condition of the supply of services, require you to consent to the collection, use, or disclosure of your personal information beyond that which we require for our purposes.

In certain circumstances as permitted or required by law, we may collect, use, or disclose your personal information without your knowledge or consent. These circumstances include the following:

  • to investigate a breach of an agreement or a contravention of a law;
  • where collection or use is clearly in your interests and your consent cannot be obtained in a timely way;
  • for debt collection;
  • to act in respect to an emergency that threatens you; and
  • to comply with a subpoena, warrant or court order.

2. HOW DO YOU COLLECT PERSONAL INFORMATION AND WHAT PERSONAL INFORMATION DO YOU COLLECT?


We collect personal information from you when you provide information directly to us; for example, when you contact us on the Site, via social media, subscribe to our newsletters, contact MMSCAN Customer Service, use our “build & price” tool to build, customize and price your Mitsubishi vehicle, locate nearby dealers, schedule an appointment with a dealer via the Site, use our “ClickShop” online car shop tool to custom build your Mitsubishi vehicle, request a quote, sign up to test drive a vehicle, provide us with your feedback (including by responding to our surveys or other requests for reviews of our vehicles and/or business), enter one of our contests, use the chatbot feature on the Site, or otherwise make inquiries to us or to our webmaster. We may also collect information about visitors to the Site using cookies and other tracking technologies, such as pixels. We may also record inbound and outbound telephone calls with you.

We may also collect or receive personal information about you from our dealerships that you visit or interact with, for example, when you test drive a vehicle, fill out a credit application and/or sign an agreement to purchase or lease a Mitsubishi vehicle at one of our dealerships.

We may also receive personal information from our financial partners, including Scotiabank, when you apply for or are approved for vehicle financing. This data may be used for communications and marketing purposes, including possibly shared with MMSCAN’s third-party partners.

We may collect and use the following personal information:

  • Your name, title, marital status, date of birth, mailing address, email address, telephone number, company name, company department
  • Your location, including postal code, city, province and country, or geolocation if you choose this function
  • Your vehicle selection, configuration selection including the model, year, make and colour of your selected vehicle, and if applicable, vehicle accessories and protection plans that you are shopping for, including price of configured vehicle
  • Your budget information, including financing, cash or lease amount, payment frequency, term, and down payment
  • Information regarding your eligibility for deals and rebates, including your status as a graduate, loyalty member, first responder and mobility and health and/or military status
  • The content of any messages that you send to us
  • Vehicle repair information, including receipts and invoices
  • If you choose to submit a credit application to us via the Site or at one of our dealerships, personal information provided in your credit application including your name, date of birth, marital status, gender, social insurance number, phone number, email address, employment information (e.g., employment status, employment type, employer name, occupation, income, business contact information, length at employer, income information, etc.), residential information (e.g., residential address, ownership or rental status, residential payment information, market value of residential property, etc.), and if you have a co-applicant, the same information about your co-applicant, as well as their relationship to you
  • Other personal information you provide to us, as required to respond to your enquiries or provide you with our products and services
  • Your customer feedback, including any response to surveys or other requests for reviews of our vehicles and/or business
  • If you speak with us by telephone, recordings of your voice and any personal information that you share with us during our call
  • Upon purchase of a vehicle, your VIN is shared with MMSCAN

Like many websites, we collect certain information automatically when you use the Site for the purposes of analyzing, enhancing and personalizing your experience, including to deliver targeted advertisements. We may collect the following information automatically when you use our Site:

  • Your computer’s or device’s operating system, Internet protocol (IP) address, browser type
  • Your access times, language, the website that referred you and your usage and activity on our Site

We may use third-party analytics services, cookies and other online tracking technologies (including pixels) to help analyze how you use our Site. See below under “Do You Use Cookies” for more information.

We limit the collection of personal information to that which is necessary for the purposes identified to our customers and collect personal information through fair and lawful means.

3. HOW DO YOU USE MY PERSONAL INFORMATION?


MMSCAN may use your personal information for the following purposes:

  • Use your name, email address, phone number, location, vehicle selection, configuration selection, selection of protection plan, information regarding your eligibility for deals and rebates, and, if applicable, information included in your credit application, to administer and process services and products requested by you, and to calculate and present available and relevant offers and inventory to you
  • Use your location to notify you of the closest Mitsubishi dealer with your consent.
  • Use information automatically collected when you use our Site, including access time, language, referring website, your usage and activity on our Site, your computer’s operating system, IP address, browser type, and location, to generate statistics, measuring the Site activities, personalizing your experience on our Site and detecting and preventing security threats.
  • Use your vehicle selection, location and feedback, to understand customers’ automotive needs and to increase awareness of the MMSCAN brand, products and services
  • Use the content of any messages that you send to us to investigate and respond to your inquiries and to otherwise provide you with customer service. This would include any attachments and their contents.
  • Use your vehicle selection, configuration selection, location, email address, mailing address and feedback to help us develop and market our brand, products, services, promotions and advertising.
  • Use your email address, mailing address and phone number to communicate with you about our products and services including purchase confirmations, technical notices, updates, security alerts and support, contests, promotions, rewards, special offers, upcoming events, newsletters and other news about MMSCAN and our selected partners, with your consent where required by applicable laws
  • Use your feedback and reviews to improve our products and services and to provide information about our products and services to other customers and prospective customers.
  • Use email, phone number, last name, mailing address, and postal code to aggregate and generate reports on advertising lead sources.
  • Use your name, email address, mailing address, and phone number to process and deliver contest entries and rewards.
  • Use your name, email address, mailing address, phone number, dealer selection, vehicle selection and budget information to respond to requests for quotes, requests for test drives, and comments, questions or other requests for information.
  • Use your email, phone number, last name, mailing address, and postal code to provide you with vehicle maintenance and safety information (such as information about mandatory and voluntary vehicle recalls)
  • Use your first and last name, email address, mailing address, phone numbers and VIN to process your warranty claims.
  • Use our recordings of inbound and outbound telephone conversations, including recordings of your voice and any personal information that you share with us during our telephone calls, to provide customer service, improve our products and services, retain recordings of our telephone calls, and for quality control and employee training purposes
  • Other purposes that we identify to you from time to time, with your consent (express or implied in accordance with applicable laws)
  • Comply with federal, provincial or local laws, or with a civil, criminal or regulatory inquiry, investigation, subpoena or summons by federal, provincial or local authorities.
  • Exercise or defend legal claims.
  • Other purposes, without notice or consent, where required or permitted by applicable laws.

4. CAN I OPT OUT?


If you do not want your personal information to be used for any of the purposes described in Section 3 above, or you do not want us to share your personal information with any of the third parties referenced in Section 9 below, you can contact us to withdraw your consent to such use or disclosure, subject to certain exceptions as required or permitted by applicable laws. Please note, however, this may impact our ability to provide you with certain goods and/or services.

Without limiting the above, if at any time you decide you no longer want to receive communications from MMSCAN or our selected partners, such as special offers, requests for customer feedback and reviews, and information on upcoming events or other marketing information, you can opt out. You can unsubscribe by clicking the unsubscribe function in the email you receive. Please allow 5-7 business days to process your request. Note that we may still send you non-promotional emails, such as emails about your account or our ongoing business relations.

MMSCAN and its dealers are separate entities with their own privacy policies and practices. For questions about your dealer’s privacy policy and practices, including opting out of marketing communications from your dealer, please contact your dealer directly.

When you purchase or lease a vehicle or obtain service for your vehicle from your dealer, your dealer will share your information with MMSCAN. MMSCAN is not responsible for its Dealers’ compliance with applicable law.

5. WHERE IS MY PERSONAL INFORMATION PROCESSED?


Your personal information will be kept in physical or digital format at our offices in Ontario, Canada and in the United Kingdom, Ireland, Japan, and the United States. Except as provided in Section 9 below, your personal information will be accessible only to employees who have a “need to know” such information to perform their duties, including members of our marketing, product planning, digital, customer service, sales incentives, aftersales, information technology teams.

MMSCAN, our affiliates, and our service providers process your personal information in countries other than Canada, including in the United States, United Kingdom, Ireland and Japan. If you are located in Quebec, please note that your personal information may be communicated or stored outside of Quebec.

Personal information transferred or stored outside of Canada will be subject to the laws of the jurisdiction(s) where it is transferred or stored, and may be accessible to foreign courts, law enforcement and national security authorities in the jurisdiction(s) where it is transferred or stored.

6. HOW DO YOU KEEP MY PERSONAL INFORMATION SAFE?


Once the purposes for which the personal information is collected and/or used are achieved (subject to any retention periods required by applicable laws), we will either (1) destroy the personal information or (2) anonymize it in order to use it for a serious and legitimate purpose, where possible and permitted by applicable laws. Personal information will be retained and/or destroyed in accordance with applicable laws. MMSCAN reserves the right to delete your information at any time without your consent.

If MMSCAN uses third parties such as service providers to process personal information on its behalf, MMSCAN requires such service providers to use similar safeguards to those used by MMSCAN, and also requires service providers to limit access to your personal information and to keep it strictly confidential. Service providers are only permitted to process your personal information for the sole purpose of carrying out services on behalf of MMSCAN.

Although we take the above steps to safeguard the personal information under our control, "perfect security" does not exist. In particular, please note that no method of transmitting or storing personal information online or by electronic means is completely secure. As a result, while we strive to protect your personal information, you should be aware that:

  • there are security and privacy limitations of the Internet which are beyond our control;
  • the security, integrity and privacy of any and all personal information exchanged between you and MMSCAN using electronic means (including, without limitation, the Site) cannot be guaranteed; and
  • any such information may be viewed or tampered with by an unauthorized third party.

We at MMSCAN restrict customer data to those who require it internally. Key roles and responsibilities related to data protection and privacy management at MMSCAN:

Privacy Officer (PO): The PO is responsible for overseeing MMSCAN’s data protection strategy and its implementation to ensure compliance with Canadian Privacy Regulations.

Legal and Compliance Team: These teams are responsible for interpreting privacy laws and regulations, providing guidance on compliance, and handling legal matters related to data protection

Information Security Team: Security teams focus on protecting MMSCAN’s infrastructure and user data from unauthorized access, breaches, and other security threats.

Product Managers: Product managers ensure that privacy considerations are incorporated into the design and development of MMSCAN’s products and services.

7. WHAT ABOUT THIRD-PARTY LINKS?


Our Site may be linked to or from another website. We encourage you to review the privacy policies of all sites which you visit, including those whose links are provided, so that you can understand how those sites process your personal information. We are not responsible for, nor does this Policy address, the privacy policies, content or data handling practices on other websites or by other organizations.

Without limiting the above, while MMSCAN encourages its dealers to meet the requirements of this Policy and fully comply with privacy legislation, each dealership is a separate legal entity, independent from MMSCAN, and is responsible for its own compliance with applicable laws and regulations.

8. DO YOU USE COOKIES?


A “cookie” is a small data file that a website can send to your browser, which may then be stored on your device or system. MMSCAN uses cookies to better serve you when you return to our Site. MMSCAN may send cookies when you visit various pages of the Site, provide information to us or respond to inquiries. You accepting the cookies on our Site enables us to identify your system by reading the cookie that has been stored on your device or system, but we cannot use information collected via cookies to identify you unless you enter personal identifiers or other personal information on the Site. Cookies that are placed on the Site cannot be used to obtain your personal information on another website.

The information collected via cookies on the Site permits MMSCAN to analyze traffic patterns on our Site, enabling us over time to provide visitors with a better experience by improving the Site’s content and making it easier to use. We also use this information to evaluate and improve the efficacy of our marketing and other business development efforts.

We use third-party analytics services to collect some of this information via cookies and other online tracking technologies, such as pixels. Such third-party services include Google Analytics, which provides us with certain data regarding the demographics of Site users as well as statistical data about the number of people using the Site. The data collected by Google Analytics on our Site includes data related to your device/browser, your IP address, approximate geographic location, pages viewed, time spent on each Site page, links clicked on the Site, and searches and other actions on the Site. The data collected by Google Analytics is also shared with Marketing Cloud Intelligence (MCI) formerly known as Datorama, who may process such data in the United States. MCI’s reporting tool uses this data to provide us with aggregated and de-identified statistical data to assess metrics such as the use of our Site and consumers’ online activities.

Other third-party pixels used on the Site are hosted by Meta, Salesforce Marketing Cloud, Snapchat, Reddit, Bing, Amazon, Twitter, Teads, Google Ads, Simplifi Holdings and Campaign Manager.

We also use information collected using cookies and other tracking technologies to deliver content and advertising to you that is customized to your interests, based on your browsing patterns on the Site. We work with advertising agencies to place cookies and other tracking technologies that allow delivery of our advertisements on third-party websites where we purchase advertising, as well as on our own Site. These types of third-party cookies also enable us to understand what advertisements you see and interact with, both on our Site and on third-party websites. However, we do not disclose your personal information to any third-party websites.

9. HOW DO YOU SHARE MY PERSONAL INFORMATION?


Affiliates

We may share all collected personal information with our affiliates, parents and subsidiaries, including our affiliated dealers, who may process such information in Canada, the United States, United Kingdom, Ireland, and Japan.


Dealerships

We, and our service providers acting on our behalf, may share your contact information (including your name, phone number and email address), dealer selection, vehicle selection, mileage and budget information with our dealerships, who may use such information to book a test drive for you, contact you regarding that test drive, provide a quote on your selected vehicle or otherwise contact you regarding your selected vehicle.

Service Providers

We may share personal information with third parties such as suppliers, service providers, contractors or agents (including our affiliates acting in this capacity) that perform services on our behalf such as processing and delivery of products and services, customer service, customer surveys, marketing, information technology and/or data hosting or processing services or similar services, or otherwise to collect, use, disclose, store or process personal information on our behalf for the purposes described in this Privacy Policy or on the customer’s behalf, such as:

Parent and Affiliated Companies: We may share information with our parent company, Mitsubishi Motors Corporation, or our global affiliates including Mitsubishi Motors North America, Inc., to support research, safety, data analysis, and product improvement and development.

Service Providers: We share information with third parties that provide services to MMSCAN, such as web hosting, data analytics, payment processing, IT services, voice command processing, customer service, connected car service, financial services, vehicle protection services, emergency service, roadside assistance and similar activities.

Transaction-Related Third Parties: We share information with other third-party businesses involved in customer transactions, such as finance companies, leasing companies, registration services, and title registration.

We reserve the right to add or change service providers at any time, in our sole and absolute discretion, without notice to you save as required by applicable law.

Other Sharing

We may disclose your personal information to law enforcement or other government officials if it relates to a criminal investigation or alleged criminal activity, and as otherwise required or permitted by applicable law. We may also disclose your personal information: (i) for fraud protection and credit risk reduction purposes; (ii) in the good-faith belief that such action is necessary to protect our rights, interests, or property; (iii) in the good-faith belief that such action is necessary to protect your safety or the safety of others; or (iv) to comply with a judicial proceeding, court order, subpoena, or other similar legal or administrative process, in each case, as required or permitted by applicable law.

We may also disclose your personal information to third parties in connection with, or during negotiations of, any merger, sale of company assets (including a liquidation, realization, foreclosure or repossession), restructuring, reorganization, financing, disposal, conveyance, transfer lease, or any other type of transaction involving all or a portion of our assets or business to or with another company.Although we take steps to protect information that is processed on our behalf by third parties, such third parties may not adequately protect your personal information and we cannot provide a definitive guarantee regarding the security of personal information that is processed by third parties.

10. WHAT RIGHTS DO I HAVE?


Depending on the province or territory where you are located, and depending on your relationship to us, you may have certain rights under applicable privacy and data protection legislation. Such rights may include, subject to certain exceptions and limitations, and subject to you providing appropriate proof of identity:

  • Right to withdraw your consent: You may have the right to withdraw your consent to our continued processing of your personal information, subject to any permitted restrictions and notice requirements. However, please note that withdrawing your consent may limit your ability to use the Site, and/or for us to otherwise fulfill the purposes described above.
  • Right to request access to your personal information: You may have the right to access personal information about you that we hold, subject to certain exceptions and limitations pursuant to applicable law. This right may include: the right to be informed of whether or not we hold personal information about you; the right to be informed of the existence, use, and disclosure of your personal information; the right to review and/or obtain a copy of your personal information; the right to be informed of the means by which your personal information was collected; where your personal information is collected from a third party, the right to be informed of the source of that personal information; the right to be informed of the period of time your personal information will be kept; the right to obtain an account of the use that has been made or is being made of your personal information and the third parties to which it has been disclosed; the right to receive a list of organizations to which we have, or may have, disclosed information about you; and/or the right to be informed when we use personal information to render a decision based exclusively on the automated processing of such information.
  • Right to request rectification of your personal information: You may have the right to challenge the accuracy and/or completeness of personal information about you that we hold, and have it amended or rectified as appropriate. Depending on the purposes for which your personal information is collected, used and disclosed, you may have the right to correct, delete or add information.
